Ontario bans realtors from using NDAs to block complaints: what it means for consumers and real estate professionals

Starting April 1, 2022, realtors in Ontario will be prohibited from using non-disclosure agreements (NDAs) and confidentiality clauses to prevent clients from filing complaints with the Real Estate Council of Ontario (RECO). The move was welcomed by RECO as a consumer protection measure and will ensure that clients can always report any issues to RECO, even if they have resolved the matter legally. However, the new legislation could negatively impact realtors' reputations, as details of any complaints will be publicly available on the RECO website. Despite this, Belleville realtor Doug Peterson believes that the ban will enhance the professionalism of the real estate industry in Ontario.
